A person issued a monitored device driving permit (MDDP) during the period of the statutory summary suspension (SSS) may only drive a vehicle equipped with a breath alcohol ignition interlock device (BAIID) with certain exceptions (see Exceptions to the BAIID Requirement for MDDP Applicants below). Commercial driver’s license holders are prohibited from driving commercial vehicles on an MDDP. See 625 ILCS 5/6-206.1(a-1).
Practice tips
- The notice sent by the Secretary of State states that the client is automatically enrolled in the MDDP. But the client still needs to return the application form attached to the notice in order to be enrolled. After the MDDP is issued, the client needs to install the BAIID within 14 days of the insurance.
- Tell the client not to drive any vehicle without BAIID during the SSS. If they did not enroll in MDDP, do not drive at all. However, if the client is qualified for one of the exemptions mentioned in this manual, he/she might be allowed to drive without BAIID.
- Inform your clients of the violations that can lead to the cancellation of MDDP. For example, removing the BAIID without authorization.
