In order for a Transfer on Death Instrument (TODI) to be effective, it must be signed, witnessed, notarized and recorded with the County Recorder of Deeds. Recording is a method to make the document a public record that others can see. If you have recorded a Transfer on Death Instrument, but you want to cancel it or revoke it, you can do so at any time. Use our TODI revocation program to help you fill out the form you need.
You must sign the revocation in front of two witnesses, and they must sign as well. The document must also be notarized and recorded with the County Recorder of Deeds. An owner can also revoke a Transfer on Death Instrument by recording a new Transfer on Death Instrument that revokes the old Transfer on Death Instrument. You cannot revoke a TODI through any unrecorded document or a will.
You must file a document with the County Recorder of Deeds office to revoke your TODI. It’s not enough to tear up the TODI document, or write a new document and never record it.
