Credit card or debt buyer affidavit for collection actions Form download
The plaintiff in a collection action must use this form if the suit is for a credit card debt or the plaintiff is a debt buyer. This form is provided so that defendants can see a sample of the form and know what to expect.
Can I use this form?
You must be the plaintiff in a case where you are suing someone for a credit card debt. Or you must be a debt buyer.
This form is provided as a resource for defendants who might be sued in such cases so they can know what to expect.
What do I need first?
You will need information about:
- The consumer debt including account and creditor information,
- The nature of the debt,
- The written contract giving rise to the debt, if applicable,
- The prior owners of the debt, and
- The court case name, number, and location.
