Identity theft affidavit - Credit card and debt buyer cases Form link
Use this series of forms if a collection lawsuit filed against you was because of identity theft. Please follow the instructions carefully as there are two separate forms: one that you file with court, and one that you send to the attorney for the party that is suing you.
Can I use this form?
You must be a victim of identity theft who was sued because of a collection related to the identity theft. You must also fill out an Identity theft affidavit.
What do I need first?
You will need:
- Your name,
- Plaintiff's name,
- Case number, and
- How you delivered this form to other parties in your case.
