Mobile home tenant moves out before the expiration of lease

A tenant may move out before the expiration of the lease for 3 reasons:

  • Park owner didn't comply with lease. The tenant  may move out within 30 days if the park owner fails to comply with the lease or the laws that govern mobile homes and parks. To move out, the tenant must provide written notice to the park owner. After the first 30 days, the tenant may only move out if you stayed in reliance of the park owner's written promise to correct the lease violation. Notices to the park owner of its managing agent must be by certified mail or personal service. 
  • The home has a huge defect. If the owner does not correct the defect within 30 days of getting notice from the tenant, the tenant can move out. The defect must be big enough not to allow the tenant to enjoy the home.
  • The park is no longer liveable. The tenant may move out without giving notice in the following situations. A condition in the park poses a threat to the health, welfare and safety of any tenant. 

If the park owner's actions are willful or negligent, a tenant may sue and have the right to damages. 

If the tenant does not give notice and it is required by the lease, the lease automatically renews. If a tenant gives the park owner notice of renewal, but then does not move out, the tenant may be liable for up to twice the monthly rent.
