Petition for Rehearing on Appeal Form link
A Petition for Rehearing is used to ask the appellate court for a new hearing. It tells the court what it overlooked or misunderstood in its decision.
Can I use this form?
The party who loses after the appellate court makes its decision may file a petition for a rehearing. You must file within 21 days of the appellate court decision.
What do I need first?
To use this form, you will need:
- The record on appeal,
- The report of proceedings, and
- Legal authorities (cases and statutes) to support your arguments.
