Protecting pets and personal property from an abuser

You can ask a judge to grant you any animals owned by

  • you,
  • the abuser, or
  • any minor child living in either household.

The judge can order the abuser to return the animal, to stay away from the animal and to not:

  • hurt,
  • sell, or
  • hide the animal.

You can also ask the judge to give you any property that you have a legal right to.

  • If you own the property together with the abuser, the judge will need to decide whether it is more difficult for you or the abuser to be without the property. (Please note that If you are or were married, you and your spouse both have a legal right to all property either of you bought during the marriage.) You must explain why you should have this property (such as you are the person who drives that car, etc).
  • If you do not own the property, the judge will not give it to you.

For more information, see Living with someone who abuses me.

You can also ask the judge to order the abuser not to sell, hide, or damage any property that you own.

Remember that for any of this to happen, you must ask for it in your Petition for an Order of Protection.
