Schools are only allowed to share a student’s personal information with the student or parent with some exceptions. People who can get a student’s record without permission include:
- Other schools where you are trying to enroll,
- Some federal or state agencies (not immigration),
- Emergency officials,
- The public as part of a directory, and
- The court as part of an order or subpoena.
The school must keep all record requests for your information. A school must record on your permanent record if it shares your personal information. These records must include the names of who requested or received the information. They also have to say the reasons the parties needed the information. You can ask the school to give you a copy of records shared with another party.
Sharing between school districts
A school may only share your student records with another school in a different district when:
- It is voluntary,
- The sharing only applies to a student enrolled in both districts and the student intends to enroll in the high school district, and
- They do not share more information with another district than they would within the same district.

Medical records privacy of [no-lexicon]adult[/no-lexicon] students
The school isn’t required to give access to medical or psychological treatment records of students age 18 or over. This also applies for students who attend college. This applies if the records are made, maintained, and used only for treatment. The student can choose to have those records reviewed. This could be by a doctor, psychologist, or other professional.
Undocumented students right to privacy
A school can’t turn over a student’s file to federal immigration agents unless there is an extraordinary circumstance that jeopardizes public safety. The school can turn over the file if a parent consents. Or if the information doesn’t contain the student’s immigration status. School officials are non-reporters. They are not required to report undocumented immigrants to federal agents.
