There are three types of OPs:
- Emergency (“EOP”) 750 ILCS 60/217
- 30-Day Interim (“IOP”) 750 ILCS 60/218
- Plenary (“POP”) 750 ILCS 60/219
Typically, a petitioner will be granted an EOP an ex parte basis until the respondent is served. Then, after a hearing, the POP can be granted. IOPs are rarely used.
The Emergency OP lasts between 14-21 days. 750 ILCS 60/220(a)(1) Often, it will last for 21 days and the hearing will be scheduled on the 21st day. This gives the sheriff the most amount of time to serve the respondent.
The Plenary OP can last up to 2 years. 750 ILCS 60/220(b).
