If you signed a Voluntary Acknowledgement of Paternity (VAP) form and want to undo it, you have to:
- sign a Rescission of Voluntary Acknowledgment of Paternity form;
- have it witnessed;
- and send it to the Department of Health and Family Services (DHFS).
DHFS must receive the form within 60 days of the date the VAP was received by DHFS.
If you wait longer than 60 days, it will be tough to undo a VAP. You will have to go to court no later than 2 years after the date the VAP was received by DHFS and prove that you only signed because of fraud, pressure or threats, or a mistake ("material mistake of fact").
