You need to pay a fee to file a case with United States Citizenship and Immigration Services (USCIS). Each of the forms below will say how much the fee costs. If you don't have money to pay the fee, you may be able to file for free. You can ask to file for free by using a fee waiver.
USCIS will only accept fee waivers for:
- Biometrics,
- Form I-90 for a replacement green card, if you already had one,
- Form I-485 for a green card— but only for applicants with U and T visas, asylum seekers and refugees, and former VAWA self-petitioners,
- Form I-751 for a conditional resident who obtained status through marriage to apply to remove the conditions on his or her residence,
- Form I-765 for employment authorization document or EAD, unless you're filing for your DACA EAD. DACA employment authorization is not eligible for a fee waiver,
- Form I-817 for benefits under the “Family Unity” program,
- Form I-821 for applying for Temporary Protected Status can be used in conjunction with EAD request above,
- Form I-881 for applying to suspend deportation from a special group of select countries),
- Form N-300 for a permanent resident to apply for a Declaration of Intention to become a US citizen,
- Form N-336 to request a hearing on an unfavorable decision on a naturalization application,
- Form N-400 for naturalization,
- Form N-470 for a permanent resident who must leave the United States for certain employment purposes and wishes to preserve his or her status as an immigrant to pursue naturalization,
- Form N-565 for Replacement Naturalization/Citizenship Document,
- Form N-600 for an individual to document U.S. citizenship status based on citizen parentage,
- Form N-600K for a child who regularly resides abroad to claim US citizenship based on parentage, and
- Form I-290B to appeal or seek to reopen or reconsider a USCIS decision concerning one of the above applications.
Fee waivers for family-based immigration are not available. There is no fee waiver for Forms I-130 or I-485 when filing a family based immigration case. There are some exceptions (see above). Forms I-131 and I-765 have no fee when they are filed together with Form I-485.
Look for USCIS's Fee Waiver Guidance Sheet for a few other limited exceptions. Please note, USCIS has recently changed its guidelines for obtaining a fee waiver. If you have any questions, speak with an immigration lawyer.
