Sealing foreclosure cases filed during Covid-19

If you are a homeowner who had a foreclosure case filed during Covid-19, you can motion the court to ask that your file be sealed. The foreclosure case must have been filed during the Covid-19 emergency and economic recovery period. This includes cases filed from March 9, 2020 through December 31, 2021. If your case was filed during this time, the court may seal your file. 

Not all cases are eligible for sealing. Foreclosure cases don’t qualify for sealing if they were filed during the Covid-19 emergency and economic recovery period under an exception to the moratoria.

These sealing rules apply to:

  • Residential homes, and
  • Dwellings with units for 6 or fewer families when the mortgagor is a landlord renting the units, even if the mortgagor does not live in one of the units.
