If your abuser violates an Order of Protection, you have 2 options:
- Call the police and file a report. Tell them you have an Order of Protection. Show it to them. If the police find that the abuser committed a crime , they may send your report to the state's attorney's office. It is a crime to violate the order of protection. The state's attorney's office can bring criminal charges against the abuser. It is only a crime to violate an Order of Protection if the abuser had been served with the Order.
- Go to court. Ask a judge to enforce your Order of Protection. If you choose court, it is best to talk with a lawyer.
If the abuser has violated the Order of Protection but is gone when you call the police, you can still report the violation to the police. Provide any evidence you have of the violation (such as security camera video or text messages) to the police.
The police may arrest the abuser. They will also decide whether to send the report to the state's attorney. They will do this if they find a crime was committed by not following the rules in the Order of Protection. Read your Order of Protection to see what the rules say. Some common rules say that the abuser must:
- Not physically abuse, harass or stalk the victim,
- Not be in certain areas or at certain addresses,
- Let the victim return to the home to pick up their property,
- Stay away from the victim's home if the abuser is under the influence of drugs or alcohol,
- Give all guns to the police, and
- Not contact the victim by cellphone, computer, mail, text, email, instant message, or social media.
