The Department of Children and Family Services (DCFS) has 60 days to finish its investigations. Investigators may request an extension if they need more time.
If the investigator believes there is proof that you abused or neglected a child , your case will become "indicated." This happens if there is credible evidence of abuse or neglect. DCFS has their own specific definitions of abuse and neglect. Each one has many possible offenses within it, which are called “allegations.” These definitions are in the Illinois Administrative Code. If you are indicated, DCFS will send you a letter stating which allegation they believe you committed.
If you are indicated, the letter will also explain your appeal rights. These include knowing the timeline for filing a notice of appeal. This is a strict deadline. So pay close attention to it if you think you might want to appeal. There is no penalty for filing a notice of appeal. But, there may be a penalty if you later decide you don't want to continue with that appeal.
If DCFS doesn't believe it has credible evidence that you abused or neglected a child,, the case will become "unfounded." DCFS will send you a letter to let you know of this decision. The case will then automatically close. Once this happens, you do not need to take any further steps.
